Terms and Conditions for Voice of Al-Aqib

These Terms and Conditions apply to the Voice of Al-Aqib mobile application, website, and related services operated by Voice of Al-Aqib (collectively, the "Service"). Voice of Al-Aqib is referred to in these Terms as the "Service Provider", "we", "us", or "our".

By downloading, accessing, or using the Service, you agree to these Terms and Conditions. Please read them carefully before using the Service. If you do not agree, do not use the Service.

1. License to Use the Service

Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device and to access the website and related services for personal or internal business purposes.

You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application or any part of the Service, except as expressly permitted by applicable law.

2. Intellectual Property

The Service Provider retains all intellectual property rights in the Service, including its code, design, trademarks, service marks, trade names, logos, branding, content, databases, and other protected materials (the "IP"). Nothing in these Terms grants you any license or right to use the Service Provider's trademarks, logos, or branding for any purpose.

You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed in or on the Service. Unauthorized copying, modification, source-code extraction, translation, or creation of derivative versions of the Service is prohibited.

3. Eligibility

By accessing and using the Service, you represent that you are legally permitted to use it in your jurisdiction. You must be at least 16 years of age, or the applicable age of digital consent in your jurisdiction, to use the Service. If you are below that age, a parent or legal guardian must review and accept these Terms on your behalf.

4. User-Generated Content and Acceptable Use

If the Service allows users to post, share, comment on, or upload content, you agree not to submit content that:

  • Is illegal or violates third-party intellectual property rights, including copyrights, trademarks, or patents.
  • Is abusive, threatening, harassing, defamatory, or hateful.
  • Contains discrimination, incitement to violence, or encouragement of illegal activity.
  • Is spam, phishing, malware, or otherwise harmful to the Service or other users.
  • Violates the privacy, publicity, or personal data rights of others.
  • Is misleading, false, deceptive, or impersonates another person or organization.
  • Contains explicit violence or sexual content, unless the Service clearly permits and appropriately restricts such content.

The Service Provider reserves the right to:

  • Remove, hide, or disable access to content that violates these Terms or applicable law.
  • Suspend or terminate accounts of users who violate these Terms.
  • Cooperate with law enforcement where illegal content or conduct is reported.
  • Moderate, filter, or restrict content to protect the Service, users, and legal compliance.

Content submitted through the Service may be visible to other users or to the public, depending on how the Service functions. Do not submit personal data of others without their permission.

5. Content Reports and Moderation Appeals

If you believe content violates these Terms, infringes your rights, or is unlawful, you may report it to the Service Provider at andriod.interactive@gmail.com. Your report should include enough information for the Service Provider to identify the content, evaluate the complaint, and contact you if follow-up is required.

Where the Service provides such features, you may also report content, block users, or mute notifications directly through the Service interface. The Service Provider may review reported content, request additional information, remove or restrict access to content, and take action against the responsible account where appropriate.

Users affected by moderation decisions may contact the Service Provider at andriod.interactive@gmail.com to request further review. The Service Provider will respond within a reasonable period, subject to applicable law and safety requirements.

6. License for User-Generated Content

By submitting User-Generated Content, you grant the Service Provider a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with operating, promoting, and improving the Service. This license does not grant the Service Provider the right to sell or sublicense your content to third parties independently of the Service.

You represent and warrant that you own or control all rights in the content you submit and that use of the content does not violate these Terms or applicable law. Processing of personal data related to User-Generated Content is governed by the Privacy Policy.

7. Account and Data Deletion

You may request deletion of your account or personal data through our Data Deletion Request page or by contacting us at andriod.interactive@gmail.com. Some records may be retained where required or permitted by law, as described in the Privacy Policy.

8. Service Changes, Charges, and Updates

The Service Provider is dedicated to keeping the Service useful and efficient. We may modify, suspend, discontinue, or charge for parts of the Service at any time. Any charges for the Service will be clearly communicated before you are required to pay.

The Application may require updates to continue functioning properly. You should accept updates when offered. If you choose not to install updates, the Service Provider may cease supporting earlier versions and the Application may not function correctly or at all.

9. Device, Internet, and Third-Party Charges

Some functions of the Service require an active internet connection, which may be provided through Wi-Fi or your mobile network provider. The Service Provider is not responsible if the Service does not function fully because you lack internet access, have exhausted your data allowance, or experience network issues.

You are responsible for any data, roaming, carrier, internet, or third-party charges that may apply when using the Service. If you are not the bill payer for the device or connection used to access the Service, you confirm that you have obtained permission from the bill payer.

You are responsible for maintaining the security and availability of your device and access credentials. The Service Provider strongly advises against jailbreaking or rooting your mobile device, as this may compromise security and may cause the Application to malfunction.

10. Termination

The Service Provider may suspend your access to the Service if you materially breach these Terms. Where the breach is capable of cure, the Service Provider may provide written notice and allow 14 days from receipt of notice to remedy the breach. If you fail to cure the breach within that period, the Service Provider may terminate your access.

The Service Provider may suspend or terminate your access immediately without notice if you violate applicable law, infringe intellectual property rights, compromise security, or engage in activity that could harm other users or the Service Provider.

Upon termination, your right to use the Service will end and you must stop using the Service and delete all copies of the Application from your devices where applicable.

11. Consumer Rights

Nothing in these Terms limits any rights you have under applicable consumer protection laws that cannot be lawfully excluded, restricted, or modified.

12. Limitation of Liability

To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, business interruption, or damages resulting from reliance on third-party information provided through the Service.

However, the Service Provider does not exclude or limit liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Any other liability that cannot be excluded or limited under applicable law.

To the fullest extent permitted by law, the total liability of the Service Provider for any claim shall not exceed the amount paid by you to the Service Provider for the Service in the 12 months preceding the claim, or the minimum amount required under applicable law, whichever is greater. If the Service is provided free of charge, liability is limited to the minimum amount permitted by applicable law.

13. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless the Service Provider, its affiliates, officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or directly related to your breach of these Terms or your intentional misuse of the Service, including User-Generated Content you submit in violation of these Terms.

This indemnification does not apply to claims arising from the Service Provider's own negligence, breach of these Terms, or violation of applicable law. In jurisdictions where consumer indemnification is restricted by law, this clause applies only to the maximum extent permitted.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the jurisdiction in which the Service Provider is established, excluding conflict of law rules, except to the extent mandatory consumer protection laws provide otherwise.

Any dispute arising out of or relating to these Terms will be brought before the courts that have jurisdiction under applicable law. Nothing in this clause limits any rights you may have to bring a claim in a court that is competent under mandatory law.

15. Digital Services Act Compliance

If the Service qualifies as an intermediary service under Regulation (EU) 2022/2065, the Digital Services Act (DSA), the following provisions apply in addition to the terms above.

Point of Contact

The Service Provider maintains a point of contact for communication with EU authorities and recipients of the Service at andriod.interactive@gmail.com. Where legally required, the Service Provider will designate an EU legal representative in accordance with Article 13 of the DSA.

Notice and Action

Users and third parties may submit notices of allegedly illegal content through the contact details provided in these Terms. The Service Provider will process notices promptly, diligently, and with human review where required by law. Notices will be acknowledged and a decision communicated without undue delay where applicable.

Content Moderation and Redress

When the Service Provider restricts access to content, suspends or terminates an account, or otherwise limits Service features because of content moderation, the affected user may receive a statement of reasons where required by law. Disputes regarding moderation decisions may be submitted to an out-of-court dispute settlement body certified under Article 21 of the DSA, where applicable, without affecting your right to seek judicial remedy.

Transparency Reporting

Where required by the DSA, the Service Provider will publish or make available transparency information about content moderation activities. Requests may be sent to andriod.interactive@gmail.com.

16. Severability

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider concerning your use of the Service, superseding any prior agreements or understandings.

18. Changes to These Terms and Conditions

The Service Provider may periodically update these Terms and Conditions. You are advised to review this page regularly for changes. We will notify you of changes by posting the updated Terms and Conditions on this page with a new effective date. Previous versions may be made available upon request by contacting the Service Provider.
